Intellectual Property Rights

All content available on this website, including but not limited to book cover designs, artwork, graphics, logos, text, images, layouts, downloadable materials, and other creative content, is the property of MMT Productions, its artists, licensors, or content creators and is protected by Canadian and international copyright and intellectual property laws.

Unauthorized reproduction, distribution, modification, publication, or commercial use of any website content is strictly prohibited without prior written permission.

Products and Services Offered

MMT Productions may offer products and services including, but not limited to:

  • eBook Cover Creation

  • Print Book Cover Creation

  • Manuscript Critiques

  • Line Editing

  • SPaG Editing (Spelling, Punctuation, and Grammar Editing)

Product descriptions, pricing, service offerings, and availability are subject to change without notice.

Ordering and Payments

All product and service orders are processed securely through approved payment providers.

By placing an order, you agree to:

  • Provide accurate billing and contact information.

  • Use a valid payment method.

  • Authorize the processing of payment for products and services ordered.

MMT Productions reserves the right to refuse, suspend, or cancel any order for reasons including, but not limited to:

  • Product or service availability.

  • Errors in pricing or descriptions.

  • Suspected fraud or abuse.

  • Violation of these Terms of Use.

Refund and Cancellation Policy

Due to the custom and digital nature of many products and services offered by MMT Productions, refunds are generally not available once work has commenced or digital products have been delivered.

Refunds, credits, or exceptions may be granted at the sole discretion of MMT Productions or where required by applicable law.

Client Content and Materials

Clients retain ownership of manuscripts, text, images, logos, trademarks, and other materials supplied to MMT Productions.

By submitting such materials, the client grants MMT Productions a limited, non-exclusive license to use, reproduce, modify, and adapt those materials solely for the purpose of providing the requested services.

The client represents and warrants that they possess all necessary rights, permissions, and licenses required to provide such materials and that their use does not infringe upon the rights of any third party.

MMT Productions reserves the right to refuse materials that may violate copyright, trademark, privacy, or other applicable laws.

Custom Cover Design Services

The following additional terms apply specifically to custom cover design services provided by MMT Productions:

Revisions and Scope

Clients are entitled to up to three (3) rounds of revisions or rework unless otherwise specified in writing. Additional revisions may be billed at MMT Productions’ standard hourly rate.

Ownership of Designs

Unless otherwise specified in a separate written agreement, copyright ownership of original artwork, concepts, rejected designs, drafts, source files, and production materials remains the property of MMT Productions.

The client receives rights only to the final approved design upon full payment and only to the extent granted under the applicable license or service agreement.

Client Conduct and Cooperation

Clients agree to communicate professionally and provide timely feedback, approvals, information, and materials necessary for project completion.

Excessive delays, refusal to cooperate, abusive behavior, harassment, or unreasonable demands may result in suspension or termination of services without refund.

Delivery and Acceptance

Upon delivery of final files, the project shall be considered complete unless the client identifies legitimate issues within a reasonable period.

Any additional work requested after project completion may require a new order and additional fees.

Early Termination

If a client cancels a project before completion, all payments already made remain non-refundable, and all work produced up to that point remains the property of MMT Productions.

Portfolio and Marketing Use

MMT Productions reserves the right to display completed projects, cover designs, artwork, and related promotional materials in portfolios, galleries, social media, marketing materials, and advertising unless otherwise agreed in writing.

Premade Cover Purchases

Premade cover purchases are governed by the license specified at the time of sale.

Unless expressly stated otherwise in writing, copyright ownership remains with MMT Productions and/or its licensors. The purchaser receives only the usage rights granted under the applicable license.

MMT Productions reserves the right to remove, discontinue, or modify products offered for sale at any time.

Digital Product Delivery

Unless otherwise stated, all products and services are delivered electronically.

Customers are responsible for providing accurate contact information and ensuring they can receive digital files and communications.

MMT Productions shall not be responsible for delays resulting from incorrect contact information supplied by the customer.

Disclaimer of Warranties

This website and all products, services, and content are provided on an “as is” and “as available” basis.

MMT Productions makes no warranties, express or implied, regarding the operation of the website, the accuracy of information, or the suitability of products or services for any particular purpose.

Limitation of Liability

To the maximum extent permitted by law, MMT Productions shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to the use of this website, products, or services.

In all circumstances, MMT Productions’ total liability shall not exceed the amount paid by the client for the specific product or service giving rise to the claim.

Privacy and Data Protection

MMT Productions collects and processes personal information in accordance with its Privacy Policy.

Payment information is processed through secure third-party payment providers. MMT Productions does not store full payment card information on its servers.

Governing Law

These Terms of Use are governed by the laws of the Province of Ontario and the applicable federal laws of Canada.

Any legal action or proceeding arising out of or relating to these Terms of Use shall be brought exclusively before the courts located in Ontario, Canada.

Dispute Resolution

Before commencing legal proceedings, the parties agree to make reasonable efforts to resolve disputes through good-faith discussions and, where appropriate, mediation.

Nothing in this section prevents either party from seeking urgent injunctive relief where necessary.

Modifications to These Terms

MMT Productions reserves the right to update or modify these Terms of Use at any time.

Changes become effective upon publication on this website. Continued use of the website following publication constitutes acceptance of the revised Terms.
